Waiver of Liability, Release and Indemnification Agreement

THE FOLLOWING IS A LEGALLY BINDING AGREEMENT. PLEASE READ IT CAREFULLY AND AGREE ONLY IF YOU AGREE TO ALL OF THE TERMS. YOU MUST AGREE TO THESE TERMS TO USE THE VINAI SERVICE.

 

VinAI Artificial Intelligence Application and Research Joint Stock Company (“VinAI”) has made available a number of its services at 2023 Consumer Electronics Show (CES) and related events for CES attendees (the “Services”).

I have voluntarily requested to use the Services.  In consideration of being permitted to use the Services, and intending to legally bind myself, and my family, heirs, administrators, executors, personal representatives and assigns, I voluntarily and knowingly agree to the following (the “Terms”):

  1. I hereby grant to VinAI the right to collect my information and data when I use/utilize the Services as well as the right to process the information and data collected for any business purpose, without further consideration or compensation and without limitation as to time or territory.
  2. I hereby grant to VinAI the right to make photographs, videotapes, audio tapes or other recordings or likenesses of me using or utilizing the Services as well as the right to use such photographs, videotapes, audio tapes, recordings or likenesses in any way, in any medium, for any business purpose, without further consideration or compensation and without limitation as to time or territory.
  3. I am using the Services of my own free will and choice, and, accordingly, I intend to, and hereby do, make as broad and inclusive a waiver of liability and release as is permitted by law, fully understanding that these Terms will be interpreted as broadly as possible in favor of VinAI. If any court of competent jurisdiction finds any part of these Terms to be invalid or unenforceable, the remainder of these Terms will continue to be valid, binding and enforceable. These Terms constitute the entire agreement between me and VinAI relating to the Services, superseding any prior agreements or understandings, written or oral, with respect to the Services.  These Terms will be interpreted under the laws of the State of California, without reference to any choice of law principals.  I did not receive any promise, representation, understanding or interpretation of any content of these Terms as an inducement to agree to the Terms.
  4. I agree to grant to VinAI the right to contact and approach me via email/cellphone number/fax, or other contact provided by me to VinAI, for purpose of sales/marketing/proposal for goods and services.
  5. I was given ample opportunity before agreeing to these Terms to clarify, to my complete satisfaction, any questions or concerns I may have had concerning the content of these Terms, and that I fully understand each and every term hereof.
  6. I acknowledge that by subscribing my information to this Services, I expressly waive my right of withdrawal.

I UNDERSTAND THAT, BY AGREEING TO THESE TERMS, I AM GIVING UP MY RIGHT TO RECOVER DAMAGES FROM OR SUE THE ORGANIZERS FOR ANY INJURY, DEATH OR DAMAGE I MAY SUFFER BY USING THE SERVICES.
